When the Act May Apply

Party Structure Work

Cutting in beams, removing chimney breasts, raising a party wall or altering shared structures.

Boundary Work

Constructing a new wall astride or alongside the line of junction.

Nearby Excavation

Foundations or drainage works within the statutory 3-metre or 6-metre tests.

A Practical Process

  1. Send drawings and structural information.
  2. Identify the relevant sections and adjoining owners.
  3. Prepare and serve the correct notice or notices.
  4. Record responses and arrange a Schedule of Condition where appropriate.
  5. Prepare an Award if a statutory dispute arises.

Building Owner Questions

Can I serve notices myself?

Yes, but invalid wording, ownership details or missing plans can delay the project.

Can work begin immediately after consent?

The applicable statutory notice period and any conditions of consent must still be considered.

What if the neighbour does not reply?

The Act contains procedures for non-response, including a further request and deemed dispute in relevant circumstances.
