Independent Guidance for Neighbours
Received a Party Wall Notice?
A Party Wall Notice is not the same as planning permission. It starts a statutory process intended to regulate notifiable work and protect both properties.
Your Next Steps
Check the Notice
Confirm the owner, work, statutory section, dates and supporting information.
Understand the Proposal
Ask for drawings, structural details and a clear description of the notifiable work.
Choose a Response
The precise response options depend upon the type of notice served.
Protecting the Property
A Schedule of Condition can record existing cracks, finishes and defects before work starts. If surveyors are appointed, an Award can regulate working methods, access and safeguards without determining planning matters.
Adjoining Owner Questions
Must I consent?
No. You should understand the proposal and the available statutory response before deciding.
Who pays my surveyor?
For typical works carried out for the Building Owner’s benefit, their owner normally pays reasonable statutory surveyor fees.
Can I prevent access?
The Act can provide access rights for authorised work, subject to proper notice and safeguards.
